Preamble
The Terms and Conditions outline the permitted actions for users of our services, including SMS and any future offerings. The Company reserves the right to update this policy at any time. All subscribers, whether directly or indirectly using our services, must adhere to acceptable use as defined by this policy, which may be revised periodically.
Illegal Use
The Provider Company's services are strictly for lawful use. Any transmission, distribution, or storage of material that violates applicable laws or regulations is prohibited. This includes, but is not limited to, content protected by copyright, trademark, trade secret, or other intellectual property rights without proper authorization, as well as material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws or national security regulations. The Provider Company bears no liability for any use of stolen property by its users.
User Responsibilities
Users must utilize the Company’s services strictly for lawful purposes. They are prohibited from posting or transmitting any content that infringes on the rights of others, violates any law, or is threatening, abusive, defamatory, invasive of privacy, obscene, vulgar, profane, or otherwise objectionable. Additionally, users must not engage in any activity that encourages criminal offenses, leads to civil liability, or violates any regulations. Without the Company’s explicit prior approval, users may not post advertisements or solicitations for products or services. Any behavior that, at the Company’s discretion, disrupts or restricts other users from accessing or enjoying the services is strictly prohibited.
Users are also not permitted to use the Company’s services for commercial solicitations, including attempts to recruit subscribers to competing online information services.
Furthermore, users must not upload, post, or share any material protected by copyright, trademark, or other proprietary rights without obtaining explicit permission from the rightful owner. It is the user’s responsibility to verify that any content shared is not protected by intellectual property laws. Users will be held solely accountable for any damages resulting from copyright infringement, violations of proprietary rights, or any other legal consequences arising from their submissions.
System and Network Protection
Any breach of system or network security is strictly prohibited and may result in both civil and criminal liability. The Company will investigate all such incidents and, if criminal activity is suspected, may cooperate with law enforcement agencies.
Examples of prohibited activities include, but are not limited to:
- Unauthorized Access – Attempting to access, probe, scan, or test the security of any system, network, or authentication measures without explicit authorization from the system or network owner.
- Unauthorized Monitoring – Intercepting or monitoring data, traffic, or communications on any network or system without the owner’s explicit consent.
- Service Disruption – Engaging in activities that disrupt or interfere with network operations, including but not limited to mail bombing, flooding, deliberate system overloading, and broadcast attacks.
- Identity Forgery – Manipulating or obscuring identifiers such as hostnames, usernames, IP addresses, or message headers to conceal identity or misrepresent information.
- Harassment and Threats – Transmitting messages that are harassing, threatening, or intended to cause harm.
- Hacking and Intrusion Attempts – Scanning or probing for vulnerabilities to gain unauthorized access to systems or networks.
- Malicious Software Distribution – Introducing or spreading viruses, malware, or any harmful code designed to compromise the security or functionality of a system or network.
Violations of these policies will be subject to strict enforcement, including account termination, legal action, and cooperation with relevant authorities.
Imdemnification
Users agree to defend, indemnify, and hold the Company, its affiliates, officers, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
- Any violation of these terms by the user.
- Unauthorized or unlawful use of the Company’s services.
- Any content transmitted, posted, or shared using the Company’s services that infringes on third-party rights or causes harm.
The user assumes full responsibility for their actions and agrees to cooperate with the Company in resolving any claims or disputes that may arise.
SMS
Users must not use the Company’s services to post or transmit any content that is unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or otherwise inappropriate. This includes, but is not limited to, content that:
- Encourages or constitutes criminal activity, civil liability, or violations of local, state, national, or international laws.
- Infringes on the rights of others, including privacy, publicity, copyright, trademarks, or other intellectual property rights, without obtaining proper authorization.
- Contains viruses, malware, or any harmful components.
- Is used for commercial exploitation or advertising without the Company’s prior approval.
The sending of unsolicited messages, including commercial advertisements and informational announcements, is strictly prohibited.
The Company does not control the content of SMS messages sent via its platform and holds no liability for their content, delayed delivery, non-delivery, or any errors occurring during transmission. Additionally, the Company is not responsible for disruptions caused by internet issues, connectivity delays, routing problems, or other technical faults.
Users must not send unsolicited SMS (spam) to recipients. All messages sent using the Company’s SMS Panel must comply with the IT Act 2000 and other relevant laws of India. Any legal violations will be the sole responsibility of the user.
While the Company aims to deliver SMS messages promptly, it is not liable for any delays, delivery failures, or service interruptions caused by technical issues, system failures, maintenance activities, or other factors beyond its control. However, the Company is committed to ensuring the highest possible success rate for message delivery through its SMS Panel.
Cost Policy
In consideration for the Company forwarding SMS through its SMS Panel, the User agrees to pay the agreed rate per SMS plus applicable taxes for messages sent within India.
The Company is entitled to charge for all messages routed through its SMS Panel, regardless of any delays, incomplete messages, or non-receipt by the intended recipient. Any changes in the tariff will be communicated to the User in advance.
Billing will occur when the User purchases credits, and the number of SMS credits used by the User will be counted for settlement. Service taxes will be applied.
The User agrees to pay the billed amount promptly in Indian Rupees (INR) upon receipt of the invoice. The bill generated by the Company will serve as conclusive proof of the SMS messages sent via the Company’s SMS Panel, and the User must honor the bill. In case of any discrepancies, the User can present their statistics, and both parties will work to resolve the issue.
The Company is not responsible for any delays, incomplete, or non-delivered SMS messages due to technical reasons.
Users must not send unsolicited or objectionable messages. Bulk SMS can only be sent to national customers within India.
In the event that TRAI (Telecom Regulatory Authority of India) imposes any additional charges, such as interconnection charges, the User will be responsible for covering those costs for any remaining SMS credits in their account. Any applicable TRAI charges will be borne by the User.
The User must specify the nature of the content, the intention behind sending bulk messages, and the primary applications for which the messages are being sent.
Compliance and Enforcement for Users
Any indirect or attempted violations of this policy, as well as actual or attempted violations by a third party acting on behalf of a Company subscriber or their end user, will be treated as a violation by the subscriber or end user themselves. Users found in violation of the Terms and Conditions may face legal action, including termination of services, without prior notice.
If you do not agree with any of the terms outlined above, we kindly advise you not to register with us. Once payment is received or even a single SMS credit is used, the Company will not be liable for any refund.
